What Is Legal Expense Insurance?

Legal Expense Insurance (LEI) provides coverage for policyholders in the event of legal action taken against them. Any individual or business can be sued for any number of reasons. Whether they were the cause of an accident or injury, a financial loss, a dispute or of damaging property, Legal Expense insurance provides financial protection to cover lawsuits as well as access to a qualified lawyer specialized in the relevant area concerned.

Sometimes compared to “prepaid legal expense plans”, Legal Expense insurance is not confined to specific anticipated events but covers unforeseen events generally as well as any legal assistance required.

Legal Expense insurance can also be known as Legal Protection insurance (LPI) or Legal Insurance.

Who Needs Legal Expense Insurance?

Anyone who can afford to pay an annual premium for legal protection can buy LEI, although it can be difficult to predict when it will actually be needed.

What Are The Different Types Of Legal Expense Insurance?

Buying Legal Expense insurance as a precaution is known as ‘Before the Event’ (BTE) insurance. Due to the unpredictable nature of requiring Legal Expense insurance it is possible to buy it as an add-on with other insurance products such as home or auto insurance.

Alternatively, Legal Expense insurance can also be bought following an event that triggers a legal response. This is known as ‘After-the-Event’ (ATE) insurance but will be considerably more expensive and is not as commonly offered.

What Does Legal Expense Insurance Cover?

Legal Expense insurance covers all legal costs associated with a lawsuit. These can include any of the following:
  • Lawyer fees
  • Court fees
  • Expert witness fees
  • Report fees

Does Legal Expense Insurance Cover Any Type Of Lawsuit?

No two insurance policies are the same, therefore it is essential to search and compare the available to see which one are the most comprehensive or cover the risk areas that are most relevant.

Certain legal events that would be covered by most Legal Expenses insurance policies include:

  • Disputes with a contractor
  • Highway Traffic Act infractions
  • Employment disputes
  • Consumer disputes
  • Business contract disputes
  • Tax investigations
  • Landlord-tenant disputes
  • Neighbour dispute
  • Bodily injury disputes
  • Defamation claims
  • Identity theft
  • Criminal defense

What Does Legal Expense Insurance Not Cover?

As with most insurance policies, there are certain exclusions. As each Legal Expense product is different it is important to check what is and what is not included. However exclusions common to most policies include:
  • Pre-existing cases
  • Fraudulent or criminal acts
  • Matrimonial or family disputes
  • Mis-selling or mismanagement of financial services
