IBA Northeast: Nationwide Mutual Fire sues against compensation

Insurer says claims are based on injuries sustained under the influence of alcohol

Nationwide Mutual Fire Insurance has filed a suit in a Pennsylvania court seeking to avoid compensating two defendants for a claim, according to reports.

The complaint was filed last October in the US District Court for the Eastern District of Pennsylvania against William Lolio Sr and Gina Lolio, for alleged breach of contract.

Nationwide argued that it is not duty bound to indemnify the defendants based on their insurance policy because the injuries for which they are making their claims were sustained while they were intoxicated from alcoholic beverages.

The insurer is represented by Joseph B. Mayers and John A. Anastasia of Mayers, Mennies & Sherr, LLP.
