Lexington Insurance Company is suing former New England Patriots tight end Aaron Hernandez, as well as the man who accuses Hernandez of shooting him in the face, reports the
Boston Globe.
Hernandez is currently serving life in prison after being sentenced to first degree murder charges in 2013.
The insurer filed suit against Hernandez and Alexander Bradley in Suffolk Superior Court in Boston, which is where Bradley claims he was shot. In doing so, Lexington identified itself as the provider of Hernandez’s home coverage, but claims that it has no duty to defend the ex-NFL star.
In particular, Lexington’s complaint alleges that Hernandez “has not made himself available for an interview” to discuss the shooting, and his refusal to supply information “has prejudiced, in every way possible, Lexington’s ability to determine coverage and defend the underlying case.”
The carrier also contends that the shooting was not an “occurrence” since it was intentional, and therefore neither of the defendants is eligible to collect on the homeowners’ policy.
Bradley’s attorney David Jaroslawicz told the
Boston Globe that he believes Lexington is just dodging its responsibility to provide clients with a payout.
“That’s why these insurance companies build these nice big buildings,” he told the newspaper.
