Two insurance companies battle over coverage of tugboats damaged in 2013 incident

A foreign insurance company, P&I Underwriters, is suing a Louisiana-based insurance company over which company should assume the most financial responsibility in connection with a tug boat which both had insured and which was involved in a crash.

P&I Underwriters filed a lawsuit on Sept. 15 against Atlantic Specialty Insurance Co. in the Eastern District Court of Louisiana regarding the assignment of liability in the case.

P&I Underwriters insured L&L Marine Transportation Inc., including a vessel that was involved in the transportation of a barge in 2013, and the sinking of another vessel -also hired to transport the barge.

P&I Underwriters said it should only be required to cover the loss once the hull policy of the tug boat, covered by Atlantic Specialty Insurance Co., is totally exhausted.
